In New Jersey, transactions are often broker-driven at first, but attorneys still play a critical role—especially during the attorney review period.
The Attorney Review Period (New Jersey/Pennsylvania Only)
One major difference is New Jersey’s and/or Pennsylvania's 3-day attorney review period.
During this time:
- Attorneys can cancel or modify the contract
- Buyers and sellers are not fully bound yet
New York does not have this same structure—contracts are negotiated before signing.

While both states involve similar steps (title search, financing, closing), timelines and procedures vary.
- New York closings tend to be more formal and document-heavy, where buyers and sellers (and their attorneys) meet in person to sign documents and provide checks.
- New Jersey/Pennsylvania closings are often streamlined through the title company. Documents are signed and delivered prior to closing and the funds are sent via wire transfer.
- In New York, if there is a bank involved there is a separate attorney that handles the loan documents and loan proceeds.
- In NJ/PA, the title company takes on that role.
